It is the policy of the University of Nevada, Las Vegas, that, absent extraordinary circumstances, teaching, research, and service will be accomplished openly and without prohibitions or restrictions on the publication and dissemination of the results of academic and research activities.  Certain federal regulations, however, may require the University to obtain permission from the Department of State, the Department of Commerce, or the Office of Foreign Assets Control before allowing foreign nationals to participate in research involving specific technologies or before sharing research information with persons who are not citizens of the United States or permanent resident aliens. 

Export laws and regulations are the bases for restricting use and access to this information and technology. They govern how certain information, technologies, and commodities can be transmitted overseas or to a foreign national on U.S. soil.  They cover exports in virtually all fields of science, engineering, and technology and apply to research activities regardless of the source of funding.  

In some situations, these regulations may require the University to obtain permission from the Department of State or the Department of Commerce before allowing foreign nationals to participate in research involving specific technologies or before sharing research information with persons who are not citizens of the United States or permanent resident aliens.

The Following Regulations guide export control activities:

The International Traffic in Arms Regulations (ITAR) regulate defense articles, services, and related technical data that are identified on the Munitions Control List. They are administered by the Department of State.

The Export Administration Regulations (EAR)regulate the export of dual use items, i.e. items with both military and commercial applications, identified on the Commerce Control List. They are administered by the Department of Commerce.

The Office of Foreign Assets Control Regulations (OFAC) regulate economic trade with foreign countries and administer the statutory economic trade sanctions imposed against several foreign countries. They are administered by the U.S. Department of the Treasury, through the Office of Foreign Assets Control.

Because these laws may conflict with our tradition of academic freedom and openness in research, and because failure to comply with these laws can have serious consequences – to include fine and sanctions for the institution, and fines and even imprisonment for individuals in extreme cases – it is important that all persons involved in sponsored research understand the regulations and implementation requirements.
