Policy on Private Professional Work [Approved Version, October 29, 1996] The University of Nevada, Las Vegas (UNLV) requires its faculty to perform in the areas of teaching, scholarly research, and other creative activities, and service in order to fulfill its mission. In regard to these activities, it is recognized that faculty and other professional staff represent a major State resource of talent and expertise. It is therefore appropriate for these professionals to be called upon to provide private consultation or other professional services to public and private entities which are not organizationally a part of the University. Such activities can benefit students by providing opportunities for enriched teaching and research, enhancing the reputations of both the professionals involved and the University. Since these activities support the basic academic purposes of the University, faculty and other professional staff are permitted by Codification of Board of Regents Statements to engage in reasonable amounts of paid private consultation or other professional services. During University working days, twenty percent of a faculty or professional staff member's time should be used as a general measure of a maximum reasonable amount of released time for private professional work. Requests for greater commitments of time must be specially considered (paragraph 10) to ensure there is to be no interference with the faculty or professional staff member's regular duties. Whatever the nature and extent of professional services provided privately as described above, they shall not interfere with, diminish the performance of, nor introduce conflict of interest with the primary duties of any faculty or other professional staff member. In particular, a faculty or staff member's teaching, research, and service responsibilities shall not in any way be compromised by the performance of private professional work. In accordance with the general governing principles expressed above, the following specific rules and interpretations shall apply: 1. Faculty and other professional staff members engaged in private professional work for which they will be compensated will keep their immediate superiors informed of the general nature and personal commitments required of such work. This information shall be reported and filed in a form, manner, and time frame as specified by the appropriate academic dean (for faculty and academic administrators) or appropriate vice president (for other professional staff) and -- in accordance with NSHE Policy -- be recorded on the form specified in item 8 below. Immediate superiors notified in this manner are responsible for institutional unit compliance concerning disposition of completed notification forms. 2. Faculty and professional staff engaged in private professional work may use their academic rank, administrative title, and their affiliation with UNLV in statements of identification or qualification. However, they must make it clear to clients that they do not act in the name of the University, and that the NSHE and the University are not parties to the contract nor liable for any of their actions. They also shall in no way imply that they represent or are empowered to obligate the University, nor shall they state or imply the position of the University on any issue. University stationery, University or State seals or logos, or any other identification which would lead to an impression that the University in some way sponsors, endorses, or is responsible for the private professional work involved may not be used. Home addresses or outside business or consulting numbers are not appropriate on business cards paid for by the University. Unless otherwise prohibited in Title 4, Chapter 3, Section 6, of the Board of Regents Handbook, those who advertise their services, establish offices, obtain listings in professional directories, or solicit any other publicity may not use the name of the University nor imply endorsement or sponsorship of the University. 5. The significant use of University resources in the performance of private professional work is prohibited without prior written authorization from the appropriate dean or vice president. Utilization of personal office space, personal computers, and local telephone service does not constitute significant use. Any costs incurred in the performance of such work resulting from the significant use of University resources shall be reimbursed by the user at competitive rates. Examples of possible significant use of University resources are long distance telephone service, postage, copying, laboratory materials and supplies, and technical or clerical services. Rates and amounts of reimbursement shall be negotiated and agreed upon between the user, academic dean and/or appropriate vice president, and the UNLV Controller's Office prior to the commencement of work. In consideration for reimbursement by the user of costs associated with the performance of private professional work which utilizes the resources of the University, the University shall waive all claim to rights or royalties from any patents or copyrights resulting from such work. 6. Personnel on "A" Contract must take personal leave for periods during which an absence from duties during regular working hours is required in the performance of private professional work. Leave for private professional work must be requested in increments of not less than one-half day. A copy of the notification form required by item 8 shall accompany the leave form. 7. Private professional work performed by personnel on "B" Contract shall not interfere with the performance of academic or other professional duties. Time commitments for such work must not cover these commitments or agreements are made in advance with the individual's immediate superior, with concurrence by the appropriate Dean and Provost. 8. The UNLV Notification Form for Private Professional Work shall be used to document the nature of and any institutional requirements regarding the intended work. The form shall be filled out and signed by the faculty or professional staff member and then routed to his or her immediate superior. The original copies of these forms will be retained by the deans or appropriate vice presidents. 9. Academic deans and appropriate vice presidents shall develop practices and procedures for implementation and records-keeping in accordance with the general guidance of this policy to address specific situations and reporting requirements appropriate to their units. 10. Exceptions to any of the provisions in this policy may be considered on a case by case basis. The faculty or other professional staff member requesting the exception must obtain approval of all administrators within his or her reporting structure.
